Georgia GOP advances additional legislation targeting Fulton County District Attorney Fani Willis.

In Georgia, Republican lawmakers are moving to enact stricter regulations on local prosecutors, a response fueled by the recent investigation into Fulton County District Attorney Fani Willis. The initiative follows Willis’s high-profile indictment of former President Donald Trump and 18 associates in August 2023, accusing them of conspiring to overturn the results of the 2020 presidential election.

### New Regulations on Local Prosecutors

The legislation, which was approved by the Georgia Senate, seeks to establish more oversight over local district attorneys and solicitors general. It introduces additional grounds for which these officials may be disciplined or removed by a newly created commission, set to begin its operations in 2024. The commission will focus not only on elected district attorneys but also on solicitors general who handle lower-tier criminal cases in various counties.

Under the proposed law, local prosecutors could face disciplinary actions for violations of bar rules, failures to notify crime victims of relevant actions, noncompliance with public records requests, or displaying “undue bias or prejudice” during prosecutorial duties.

State Senator Bill Cowsert, a Republican from Athens who is running for the attorney general position, emphasized the need for this legislation by citing public concerns regarding the independence and impartiality of prosecutors in Georgia. Cowsert, however, denied that the bill was specifically aimed at Willis.

### Different Perspectives on the Bill

The lieutenant governor of Georgia, Burt Jones, has expressed a contrasting viewpoint. Endorsed by Trump in his gubernatorial campaign, Jones asserted that the scrutiny surrounding Willis’s actions lends credence to the necessity of the proposed oversight. He stated that the bill would empower the Prosecuting Attorneys Qualifications Commission to hold accountable those district attorneys who lack transparency or engage in misconduct.

This divergence in opinion highlights the contentious political climate within the state, particularly as several senators backing the bill are also in the race for statewide office, with primaries approaching on May 19.

### Context of the Legislation

The recent developments in Georgia come on the heels of 140 complaints filed with the commission in 2025, of which only three were not dismissed. This includes a case against Washington County Solicitor General Michael Howard, who resigned amid an investigation and agreed to abstain from future candidacy for prosecutor positions. Earlier this session, the Senate also passed legislation intended to enhance the investigatory power of the commission.

While the bill aims to respond to perceived deficiencies in prosecutorial accountability, critics remain skeptical about its effectiveness. For instance, Willis herself had previously engaged in a tense exchange with Republican Senator Greg Dolezal, underscoring the highly politicized nature of her case and the scrutiny she has faced.

### Legislative Turn of Events

On the same day that the Senate approved the oversight measure, a separate proposal to shift the elections for district attorneys and other local officials in five Democratic-majority metro Atlanta counties to a nonpartisan basis was voted down. This measure would have included Willis, but it failed despite support from various Republican lawmakers, indicating potential divisions within the party.

Another initiative was introduced, which would have granted the Georgia attorney general the authority to intervene in serious criminal cases without the district attorney’s consent. However, after negotiations, the bill was altered to allow district attorneys to seek the attorney general’s assistance, illustrating a compromise that garnered bipartisan support.

In January 2024, the Georgia Senate established the Special Committee on Investigations, focusing specifically on allegations of misconduct against Willis regarding her prosecution of Trump. As these legislative discussions unfold, the implications for local prosecutorial independence and accountability will be closely monitored by both supporters and opponents of the reforms.
