DOJ authorizes use of firing squads as federal executions increase under Trump administration

Washington, D.C. — The U.S. Department of Justice has announced a significant shift in its execution protocols, now permitting the use of firing squads. This policy change comes as the Trump administration aims to increase the pace of federal executions following a temporary halt during the Biden administration.

New Execution Methods Authorized

In a statement released on Friday, officials confirmed that firing squads will be included as a permissible method of capital punishment at the federal level. This marks the first time the federal government has officially included firing squads in its execution protocols, despite their use in several states. Presently, five states—Idaho, Mississippi, Oklahoma, South Carolina, and Utah—allow executions by firing squad.

Alongside this new policy, the Justice Department is reinstating single-drug lethal injections using pentobarbital. This method was previously used during the first Trump administration to carry out a record number of executions compared to any U.S. president in modern history. Pentobarbital had been removed from federal execution protocols during the Biden administration over concerns about the potential for inflicting “unnecessary pain and suffering.”

Acting Attorney General Todd Blanche articulated that the prior administration’s approach to capital punishment did not adequately protect the American public. He stated, “The prior administration failed in its duty to protect the American people by refusing to pursue and carry out the ultimate punishment against the most dangerous criminals, including terrorists, child murderers, and cop killers.” He emphasized that under President Trump’s leadership, the Justice Department is renewing its commitment to enforcing the law on behalf of victims.

The shift to firing squads and pentobarbital is part of a broader initiative to expedite federal executions. Currently, only three individuals remain on federal death row, as the Biden administration converted 37 death sentences to life imprisonment during its term. However, the Trump administration has already authorized pursuing death sentences for 44 defendants.

The introduction of firing squads has sparked debates about the ethical implications of capital punishment. Critics argue that such methods may lead to suffering, citing a recent execution in South Carolina where an autopsy revealed that the bullets did not pierce the heart of the executed individual, likely causing them pain while still conscious.

The Biden administration had previously rescinded the pentobarbital policy after a review highlighted concerns regarding its potential to cause significant suffering. Attorney General Merrick Garland noted that there remains “significant uncertainty” about the method’s humane application.

Under former Attorney General William Barr, the Justice Department had streamlined execution processes by allowing lethal injections or other state-prescribed methods. The Trump administration’s recent report opposes the Biden administration’s findings, arguing that injections with pentobarbital lead to a rapid loss of consciousness, thereby preventing pain.

The Current Landscape of Federal Death Row

Notable individuals currently on federal death row include Dylann Roof, who was convicted for a racially motivated attack resulting in the deaths of nine Black parishioners in Charleston, South Carolina; Dzhokhar Tsarnaev, associated with the Boston Marathon bombing; and Robert Bowers, who was found guilty of the tragic shooting at Pittsburgh’s Tree of Life synagogue.

As federal executions are poised to resume, the legal and ethical ramifications will likely continue to be subjects of public discourse and judicial scrutiny.
